SculptIQ is operated by Verratti Brothers LLC, an Illinois limited liability company (“SculptIQ,” “we,” “us,” “our”).

Agreement to terms

By creating an account or using SculptIQ (“the Service”), you agree to these Terms of Service. If you're using the Service on behalf of a business (a “Practice”), you're agreeing on that business's behalf and confirming you have the authority to do so.

What SculptIQ is — and isn't

SculptIQ is a lead qualification, patient consultation, and appointment scheduling tool for aesthetic medicine practices. It uses artificial intelligence to converse with prospective patients, answer general questions, and help schedule consultations.

SculptIQ is not a medical provider. Nothing generated by the AI consultation assistant constitutes medical advice, diagnosis, or treatment recommendations. All medical decisions remain solely between the patient and the Practice's licensed medical providers. Practices are solely responsible for the medical care they provide and for reviewing and configuring the AI assistant's behavior appropriately for their practice.

Practice accounts

You must provide accurate information when creating a Practice account. You're responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must be a legitimate, licensed aesthetic medicine practice (or authorized representative of one) to use the Service.

Acceptable use

You agree not to: use the Service for any unlawful purpose; attempt to bypass, disable, or interfere with the Service's security features, including attempts to manipulate the AI assistant into behavior outside its intended boundaries; use the Service to collect information from individuals under 18 in a manner inconsistent with this Terms of Service and our Privacy Policy; or misrepresent your practice, your credentials, or the procedures/pricing you offer through the Service.

AI-generated content

Responses generated by the AI consultation assistant are produced by third-party AI models (currently Anthropic's Claude) and, while designed with specific guardrails, may occasionally be inaccurate or incomplete. Practices are responsible for reviewing how the assistant represents their practice and for correcting any misrepresentation. SculptIQ is not liable for decisions made based on AI-generated content, medical or otherwise.

Payment terms

Paid subscription plans, billing cycles, and cancellation terms will be presented at the time a Practice subscribes to a paid plan. This section will be updated with full billing terms once paid plans are available.

Data ownership

Practices retain ownership of their own business data and the patient data collected through their use of the Service. SculptIQ does not claim ownership over Practice or patient data, and uses it solely to provide the Service as described in our Privacy Policy.

Third-party services

The Service integrates with third-party providers (including Google Calendar, when connected). Your use of those integrations is also subject to the relevant third party's own terms. SculptIQ is not responsible for the availability or behavior of third-party services outside our control.

Termination

We may suspend or terminate accounts that violate these terms. Practices may cancel their account at any time by contacting us; see our Privacy Policy for how we handle data after account closure.

Disclaimer of warranties

The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee the Service will be uninterrupted, error-free, or that AI-generated responses will always be accurate.

Limitation of liability

To the fullest extent permitted by law, SculptIQ, Verratti Brothers LLC, and their officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service. Our total liability for any claim arising from these terms or the Service is limited to the amount you paid us in the 12 months preceding the claim, or $100 if you have not made any payments to us.

Governing law

These terms are governed by the laws of the State of Illinois, without regard to its conflict of law principles. Any disputes arising under these terms will be resolved in the state or federal courts located in Illinois.

Changes to these terms

We may update these terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
